Arizona Luxury Lawns & Greens – Tucson’s Standard 10-Year Installation Warranty

The term "Synthetic Turf" as used herein, shall only include work performed by the manufacturer or Arizona Luxury Lawns. This guarantee shall not cover any defect, failure or damage in or to the Synthetic Turf, Borders and Pavers, which is: 

(a) subject to abuse, misuse, negligence;
(b) installed, repaired, altered or replaced by any person other than Arizona Luxury Lawns & Greens - Tucson;
(c) damaged, directly or indirectly, including but not limited to, on account of, accident, vandalism, machinery, spiked shoes, animals, misuse, fire, flood, chemical reaction, acts of God, static or dynamic loads exceeding the manufacturers specifications at the time of the installation, improper or faulty subsurface preparation, failure of the subsurface after the time of installation including settling of the surface, and use of dry cleaning fluids or improper cleaning methods;
(d) Exposed to light other than natural or approved light;
(e) Damage from ruptured irrigation lines, and or non-terminated water sources below artificial grass are not covered by the installation or manufacturer's warranty;
(f) Installation is warranted for a period of 10 years which covers sink holes, seam ruptures or loose edges caused by installation errors.

Acts of God, vandalism, excessive water from pool, slip-n-slide, portable sprinkler or portable pools are not covered under the installation warranty. Synthetic Turf is considered a consumable product; therefore, this warranty excludes wear and tear;

(g) Weeds that are along the edges of the turf, Broadleaf weeds and nut grass are not covered under the warranty; please see tip sheet in your warranty packet on how to care for those;
(h) Neither Arizona Luxury Lawns & Greens nor Synthetic Grass Warehouse can guarantee EXACT color match between installations as dye lots can fluctuate between manufacturing runs; 
(i) Arizona Luxury Lawns & Greens is not responsible for damage to turf system caused by reflection or magnified sun light from any source; window, table or any other reflective source;
(j) Arizona Luxury Lawns & Greens is not responsible for damage to turf system caused by sprinkler systems that remain intact and functional, which includes calcium hard water buildup and staining; 
(k) Arizona Luxury Lawns & Greens is not responsible for damage to turf system caused by homes or properties without proper water drainage, which includes lack of gutters. Turf is designed and manufactured to allow proper rainwater drainage. Homes or properties without gutters can experience unnatural wear to turf and turf foundation, diminishing overall look and lifespan.

This guarantee is expressly in lieu of all conditions and warranties expressed or implied in fact or by law or otherwise, including without limitation, any implied conditions or warranties as to merchantability or fitness for a particular purpose. No person or party is authorized to create any obligation or liability for AZ Luxury Lawns LLC, or the manufacturer, and only the guarantee expressed herein shall apply. 

The manufacturer's obligations under this guarantee are restricted to the repair or, at its sole options, replacement of all, or the afflicted parts covered herein. The manufacturer's liability under this warranty is limited to the material value of the item to be repaired or replaced. The remedy of repair or replacement set forth herein shall be the sole remedy and the manufacturer or Arizona Luxury Lawns shall have no other obligations or liability in connection with any matter or thing, including without limitation, damages for personal injury or damages related to lost revenue, increased costs, downtime costs and all other indirect or consequential damages.

The manufacturer and Arizona Luxury Lawns endeavor to handle all warranty claims promptly and professionally conditional on the customers' account being in good standing at the time of the claim. It is agreed that all claims by purchaser made under the foregoing guarantee shall be invalid and null and void unless made in writing within ten (10) years from the date of manufacture and within thirty (30) days of learning of the cause giving the rise to its claim.

Synthetic Grass Warehouse, Inc. ("SGW") Manufacturer's Warranty Is as Follows If You Have Purchased Synthetic Grass Manufactured by Synthetic Grass Warehouse, Inc.

SGW Warrants That If the Synthetic Grass It Manufactured and Supplied Proves to Be Defective in Materials During Normal Use of the Product, Within Fifteen (15) Years from the Date of Manufacture, Or Suffers Significant Fading, Breakdown or Degradation Due To Exposure to Natural Ultraviolet Rays Within The Same Fifteen (15) Year Period, SGW Will, At Its Sole Option Either 1) Repair or Replace the Affected Area Without Charge to the Purchaser, Or 2) Issue A Credit Equal to the Cost of the Synthetic Grass Material. For The Purpose of This Warranty the Product Shall Be Deemed to Have Failed in Ultra-Violet Stability If the Original Tensile Strength of the Product Decreases by More Than 50 Percent.

Proration Is as Follows: Years 1-10 (100%), Years 11-13 (50%), Years 14-15 (25%).

In The Event That SGW Elects to Issue a Credit In Lieu Of Repair or Replacement, Said Credit Shall Only Apply to the Affected Area of the Synthetic Grass Giving Rise to the Claim. The Credit Shall Be Issued to the Retailer, As A Percentage of the Replacement Cost of New Synthetic Grass of the Same or Comparable Quality. The Credit Will Be Good Only Toward the Purchase of SGW Synthetic Grass. There Will Be No Cash Payment.

• Warranty Does Not Cover Any Type of Matting of This Product, Regardless of the Cause.
• This Warranty Only Applies to Synthetic Grass Products That Have Been Purchased From SGW
• This Warranty Is Limited to the Remedies of Repair or Replacement of the Affected Areas of the Synthetic Grass.
• This Warranty Does Not Cover the Installation of the Synthetic Grass or Any Issues Stemming from the Installation.
• This Warranty Does Not Cover Surface Deterioration Resulting from Normal Wear and Tear or Any Damages Caused by Site Conditions and Improper Installation Beyond Its Control, Accidents, Misuse, Abuse, Neglect, Exposure of the Product to Inappropriate Footwear (I.E. Metal Cleats), Tobacco Products, Chemicals or Cleaning Agents, Fire, Floods, Vandalism, Acts of God.
• SGW Hereby Disclaims Any and All Warranties, Express or Implied, Including Warranties of Merchantability and Fitness for a Particular Purpose and Disclaims Liability for Incidental or Consequential Damages.
• SGW Specifically Excludes and Will Not Pay Consequential or Incidental Damages Under This Warranty. This Includes Any Damages Arising Out of or in Connection with the Use or Performance of the Synthetic Grass, Including, But Not Limited to Damages for Economic Loss, Expense, Personal Injury Etc.
• This Warranty Is Non-Transferable. This Warranty Is Only Extended to the Original Purchaser.
• All Warranty Claims Must Be Presented in a Timely Fashion to SGQ as a Printed Description with Photos as Soon as an Issue with the Synthetic Grass Becomes Evident.
• This Warranty Does Not Cover Sun Magnification and Melting from Low E Windows or Matting.
• This Warranty Excludes Putting Greens.
